Speaking the Language of Prosecutors – Taking a Case from Investigation to Verdict
Ben David, District Attorney New Hanover and Pender Counties in North Carolina
A defendant can rob more money by using a computer than with a gun and a ski mask. The harm, especially to vulnerable victims like seniors, can be very traumatic and hidden by shame which hurts the reporting of these cases. Other times, it is a betrayal of trust by an employee or family member. The penalties for these financial crimes are also far less harsh at the time of sentencing than violent crime like armed robbery. This gives more savvy defendants further incentive to choose this means of exploitation and they often amass many victims over several years before being caught.
Once great auditors and investigators catch them, the real work begins–convincing prosecutors like me that it is worth the time and resources of their offices to go after these defendants (who frequently reside far away in other jurisdictions). By thinking like a prosecutor, participants will not only be far more effective at catching scammers, they will be far more likely to have them convicted of their crimes because they will speak the same language as the person analyzing their case to see if it should be brought into a courtroom.

Using interactive social media examples, this practical and entertaining session will use current events in business and even in our social lives to demonstrate how to“See Fraud through the COSO Lens.” You can apply this new view in your risk assessments at a ERM and individual audit level.
The session will open the eyes of internal auditors to look at fraud in a different manner. Most audit departments do consider fraud, but are they seeing beyond the tip of the iceberg? 47% of CFOs say they could justify unethical behavior to help their organization survive the economic downturn. Nearly half of those surveyed stated that they would be willing to cut ethical corners to meet performance targets, particularly in the last four years. 40% of those surveyed stated that their companies do business in countries in which bribery and fraud occur frequently.
